Website Terms

These Terms and Conditions (the "Agreement") shall govern Your use of our website (the "Website") and our platform, an RNG based social gaming tool (the "Platform").

Important notice: this platform is not a gambling operator. All games are demo versions and no real money deposits or withdrawals are accepted. Participation is completely free with no consideration required. Winners are determined based on skill and/or through random selection (raffle).

1. Access to Website and Account Creation

   1. The Tournaments are available for access by users aged 18 years or over. By signing up, you hereby declare and warrant that you are over 18 years of age or such higher minimum legal age of majority as stipulated in the jurisdiction of your residence and are, under the laws applicable to you, legally allowed to participate in the Tournaments. We reserve the right to carry out verification checks to confirm the accuracy of all account registration details you provide. When these checks are unable to verify your age, We reserve the right to ask for additional proof. If we remain unable to confirm any detail provided by you, we reserve the right to suspend your account or withhold prizes until we receive satisfactory proof, as determined in our sole discretion.

   2. Employees of our company, their close relatives and anyone otherwise connected with the organisation or judging of the Tournament may not enter into this Agreement.

   3. Free Mode of Entry (FMOE): No entry fee shall be imposed on You for the participation in any Tournament. You shall not be required to make any purchase, deposit funds, or provide any form of consideration in order to participate in a Tournament. The Platform does not accept deposits or process withdrawals of real money.

   4. If You are located in the following countries You will not be able and are not permitted to access or participate in any Tournaments offered on the Platform: Afghanistan, Australia, Belgium, Burma (Myanmar), Canada, China, Cuba, Democratic People's Republic of Korea (DPRK/North Korea), Eritrea, France, Germany, India, Iran, Italy, Libya, Malta, Montenegro, Netherlands, Norway, Romania, Somalia, South Korea, South Sudan, Spain, Sudan, Sweden, Syria, Turkey, Ukraine, United Kingdom (UK), United States of America (USA), Venezuela, Yemen, Zimbabwe and any other state or country as we may determine from time to time (together "Banned Territories"). We reserve the right to amend the list of Banned Countries at any time and in our sole discretion without prior notice or to withhold or cancel the award of any Prizes awarded for participation in the Tournament if We find that the End User is accessing the Platform from one of the jurisdictions of the Banned Territories.

2. Account Creation

   1. You must create a user account with us in order to participate in any Tournament ("Account"). You can create an Account by accessing the Website.

   2. When creating an Account and in order to be eligible to participate in a Tournament, You are required to provide personal data, including: Your name and email address. Any personal data collected by us shall be processed in accordance with the relevant data protection laws set forth in Clause 6 of this Agreement.

   3. You shall choose a virtual avatar where such virtual avatar shall represent Your Account during a Tournament ("Avatar"). You accept that We in our sole discretion reserve the right to suspend, restrict or reject at any time any Avatar used on an Account or for a Tournament.

   4. You are entitled to open only one Account in Your name. You hereby acknowledge and agree that You may be disqualified from participation in any Tournament at any time should You have more than one Account in Your name.

3. Virtual Currency (Coins) and Prizes

   1. The Platform operates exclusively with virtual currency ("Coins"). Users may earn Coins through participation in daily and weekly tournaments, achievements, and ranking positions. These Coins have no real-world monetary value and cannot be purchased with real money.

   2. In specific cases, any user determined by us to be a "Winner" of a Tournament ("Winner") based on their skill performance or through a random selection process (raffle) may be entitled to exchange Coins for prizes such as gift certificates in our online shop ("Prize"), as determined by us in our sole discretion from time to time. You acknowledge and agree that You will be responsible for any tax obligations arising out of You receiving a Prize and agree to fully indemnify us against any tax obligation resulting from a Prize being awarded to You.

   3. You hereby agree and accept that We reserve the right to grant or withhold any Prizes in our reasonable discretion; and that any violations of this Agreement or Applicable Law (defined in Clause 3.8 of this Agreement) or failure to comply with any reasonable requests for further information from us may result in the cancellation of awarding a Prize to Winners.

   4. You acknowledge and agree that all Prizes and their Winners shall be listed on the Website. Prizes are non-transferable. Prizes are subject to availability and We reserve the right to substitute any Prize with another Prize of equivalent value without notice.

   5. The Winner will be notified by email using the email address linked with the Account within forty-eight (48) hours following the finalization of the results of the Tournament. If the Winner cannot be contacted or does not claim the Prize within seven (7) working days following notification by email, We reserve the right to withdraw the Prize and select an alternative Winner in our sole discretion.

   6. We will notify the Winner of the means by which we will transfer the Prize to the Winner.

   7. Decisions in respect of all matters relating to any Tournaments and the Platform shall be in our sole discretion.

   8. As a condition to receiving a Prize, You agree that We reserve the right to make further reasonable information and documentation requests (as determined by us in our sole discretion) necessary for compliance with any and all Applicable Laws, rules or regulations to which We (or any entity belonging to the same group of companies as us) must adhere to ("Applicable Law"). No Prizes shall be awarded to You unless You adhere to any and all reasonable requests for further information and documentation by us. In particular, any Winner shall provide any and all information and documentation required for us to be able to comply with its obligations under Applicable Law, including but not limited to tax compliance requirements. You hereby acknowledge and agree that it may take up to fourteen (14) working days to receive a Prize following receipt by us of further information and documentation.

   9. Any failure to comply with our request for further information and documentation as per this Agreement may result in the suspension or termination of Your Account.

4. Tournament and Gameplay

   1. All games offered on the Platform are demo versions. The Platform is not a gambling operator and does not offer real-money gambling services.

   2. Tournaments are primarily skill-based, where winners are determined by their gameplay performance, strategy, and skill level. In some cases, winners may be selected through a random process (raffle).

   3. The Platform is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter or any other social network upon which the Platform and Tournament(s) are advertised.

   4. We reserve the right to suspend, cancel or reschedule any Tournament at any time and without notice. Any suspension, cancellation or rescheduling of a Tournament will be notified to entrants as soon as possible.

   5. We reserve the right to suspend and/or cancel Your participation in a Tournament at any time. Our decision on Your participation and eligibility to participate in the Tournament is final and may not be contested by You or any other participant in a Tournament.

   6. We reserve the right to offer a specific Tournament to a specific group of customers.

   7. We reserve the right, in our sole discretion, to at any time change, update or amend details regarding the Tournaments.

5. Leaderboards, Rankings, and Achievement System

   1. Tournament Leaderboards

      1. Each active tournament features a leaderboard displaying top participants.

      2. Leaderboards contain information including: End User nickname, earned points, current rank, and potential prize (if applicable).

      3. Leaderboards may be updated in real-time or with a short delay.

      4. We reserve the right to adjust leaderboard positions in cases of suspected unfair play or technical errors.

      5. You acknowledge that your participation and ranking information may be visible to other users of the Platform.

   2. Global End User Rankings

      1. The Platform maintains global End User rankings which may include weekly, monthly, and all-time rankings.

      2. Rankings are based on rating points earned through tournament participation and achievements.

      3. Rankings may affect visible achievements and End User icons displayed on the Platform.

      4. Global rankings serve as an additional gamification mechanism and may influence access to certain tournaments.

      5. We reserve the right to reset or adjust rankings at our sole discretion, including when unfair play is detected.

   3. Personal End User Profile and Statistics

      1. Each End User has access to personal statistics in their account dashboard.

      2. Personal statistics include: current global ranking position, results in past tournaments, and status in active tournaments.

      3. We do not guarantee the continuous availability of historical statistics and reserve the right to limit the period for which such data is stored.

      4. Statistics are provided for informational purposes only and might be subject to occasional technical errors.

   4. Coin Earning Mechanisms

      1. Coins are the Platform's internal currency with no real-world monetary value.

      2. Coins cannot be purchased with real money, withdrawn, or transferred to other users.

      3. Users can earn coins through: tournament participation and earning other achievements, if applicable.

      4. We reserve the right to adjust the coin earning rates and mechanisms at any time.

      5. Coins may be required for accessing certain tournaments or exchanging for in-platform features.

      6. In our sole discretion, we may provide the option to exchange coins for real prizes such as gift certificates in our online shop.

   5. Achievement System

      1. The Platform may implement an achievement system rewarding specific actions or milestones. Achievements are displayed in the End User's profile.

   6. Data Display and Errors

      1. While we make reasonable efforts to ensure the accuracy of leaderboards, rankings, and statistics, we do not guarantee their absolute accuracy at all times.

      2. In case of technical errors or disputes, our decision regarding correct standings shall be final.

      3. We reserve the right to correct any errors in point calculations, leaderboards, or coin balances at any time.

      4. No compensation will be provided for temporary display errors or downtime in the statistics systems.

6. Fair Play

   1. By participating in the Platform, you commit and undertake not to engage in unfair or dishonest practices. Furthermore, you accept that any actions or attempted actions that undermine or compromise the integrity of the Platform, disrupt user experience or provides an unfair advantage, as determined in Our sole discretion, shall, without prejudice to the below, be considered a material breach of these Terms and Conditions.

   2. For illustrative purposes only, unfair or dishonest practices may include (without limitation): (i) the creation of multiple accounts by an individual to participate in the Platform; (ii) the exploitation of bugs or glitches; and (iii) the use of bots, automated scripts, APIs or third-party tools designed to manipulate or artificially enhance gameplay.

   3. We reserve the right to investigate any activity or patterns we deem irregular and/or suspicious. During this investigation process, we may, (i) suspend your account; and/or (ii) withhold any prizes. Moreover, where we determine, in our sole discretion, that you have engaged in such unfair practices, then without prejudice to Our rights under these terms and under statutory laws (all of which are expressly reserved), we reserve the right to take any required actions without prior notice including without limitation the following:

   • Disqualification;
   • Voiding, withholding or revoking of any Prizes earned through unfair or dishonest practices; and/or
   • Suspension or revocation of your Platform account.

7. Data Protection

   1. By Your use of the Platform or Website You hereby consent to our (and any of our authorized processors) processing of your personal data pursuant to the provisions of any and all Applicable Laws and in accordance with our Privacy Policy.

   2. By creating an Account and participating in a Tournament, the Winner acknowledges and agrees to us publishing their name and Avatar in any publicity material. Any personal data of the Winner or any End Users will be used solely in accordance with any and all Applicable Laws.

   3. Notwithstanding any provisions in the Privacy Policy, You hereby recognize that You retain the right to withdraw Your consent to the processing by us of Your personal data by requesting the closure of Your Account and any closure of Your Account shall result in our termination of processing Your personal data.

8. Termination

   1. You hereby acknowledge and agree that We reserve the right to close Your Account if We at any time in our sole discretion, in particular in case any activity on Your Account contradicts Applicable Law or is used for illicit purposes, including, but not limited to money laundering.

   2. Upon closure of Your Account, We will no longer provide you access to Your Account or any Tournaments offered on the Platform. Your participation in any Tournaments that may still be pending at the time of the closure of Your Account will be voided and You will not be entitled to receiving any Prizes.

9. Intellectual property

   1. For the purposes of this Agreement, "Intellectual Property" means any invention, designs, formulas, know-how, processes, business methods, patents, trademarks, service marks, copyrights, code, ideas, writings, illustrations, photographs relating to our brand, and any and all material describing or illustrating such property, whether in hard copy or digital form.

   2. All Intellectual Property will at all times remain our property. Any and all intellectual property rights that arise as a result of this Agreement or Your use of the Platform shall belong to us.

10. Complaints

    1. You may address any complaints through the customer support email address provided on our Website. We will use our best efforts to resolve any complaint promptly and without delay.

11. Limitations of liability

    1. You hereby agree to hold us harmless for any of the following types of loss or damage even in each case if the Party has been advised of the possibility of such loss or damage:

       1. indirect or consequential loss; or

       2. loss of profits, revenue, contracts or anticipated savings.

    2. We shall not be liable for any breach of these Terms directly or indirectly caused by circumstances beyond our reasonable control where We are prevented from performing our obligations under this agreement and where such failure to perform does not relate to our fault or negligence ("Force Majeure Event"). If the Force Majeure Event prevents us from materially complying with our obligations under this agreement and it continues for more than ten (10) days, you may terminate the Agreement with immediate effect by giving written notice.

    3. We shall not be held liable for any risks related to the technology used on the Platform or in relation to the Account, including, but not limited to, the failure of hardware, software, and Internet connections, risk of malicious software introduction and any other risks that relate to third parties which may gain unauthorised access to the Website or the Platform. We shall not be responsible for any loss of such information resulting from any technological failure powering the Website or the Platform.
